Terms & Conditions

These Terms apply to all users of the Website and to every contract concluded between Quick Response, Lda. (trading as Yes We Brand) and the customer.

We reserve the right to update these Terms at any time. The version published on the Website at the time of your order will apply to that order. Continued use of the Website after changes constitutes acceptance of the updated Terms.

You must be at least 18 years old and have legal capacity to enter into binding contracts. By placing an order you confirm that you meet these requirements.

All products shown on the Website are subject to availability. We make every effort to display product information, images and prices accurately. However, minor variations in colour, size or appearance may occur due to screen settings or manufacturing tolerances.

We reserve the right to limit quantities, refuse orders, or discontinue products at any time without prior notice.

Prices are shown in euros (€) and include Portuguese VAT at the applicable rate, unless otherwise stated. Shipping costs are calculated and shown before you complete your order.

We accept the payment methods indicated on the Website. Payment is due at the time of order. Ownership of the products passes to you only after full payment has been received.

Your order constitutes an offer to purchase. We will send an order confirmation by email. The contract is formed when we confirm acceptance of your order (usually by shipping confirmation or explicit acceptance).

We reserve the right to cancel any order for reasons including (but not limited to) product unavailability, pricing errors, suspected fraud, or inability to process payment.

Delivery times are estimates only and start after we have confirmed the order and received payment. Risk of loss or damage passes to you upon delivery (or attempted delivery) to the address you provided.

You are responsible for providing accurate delivery details. Additional costs arising from incorrect addresses or failed delivery attempts may be charged to you.

If you are a consumer (natural person acting outside your trade, business or profession), you have the right to withdraw from the contract within 14 days without giving any reason, in accordance with Portuguese and EU consumer law (Decreto-Lei n.º 24/2014 and Directive 2011/83/EU).

The withdrawal period expires 14 days after the day on which you (or a third party indicated by you, other than the carrier) acquire physical possession of the goods.

To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g. letter or email to hello@yeswebrand.co). You may use the model withdrawal form available on request, but it is not obligatory.

You must return the goods without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal. You bear the direct cost of returning the goods unless we have agreed otherwise.

We will reimburse all payments received from you, including standard delivery costs (except any supplementary costs arising if you chose a delivery method other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed of your decision to withdraw. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back.

The right of withdrawal does not apply to:

• Goods made to your specifications or clearly personalised;
• Goods which are liable to deteriorate or expire rapidly;
• Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
• Goods which are, after delivery, inseparably mixed with other items.

In addition to the statutory right of withdrawal, products that are defective or not as described are covered by the legal guarantee of conformity under Portuguese law (Decreto-Lei n.º 84/2021).

Please contact us at hello@yeswebrand.co as soon as possible if you receive a damaged, defective or incorrect product. We will arrange repair, replacement or refund as appropriate under applicable law.

All content on the Website (including text, graphics, logos, images, product designs, and software) is the property of Quick Response, Lda. or its licensors and is protected by Portuguese and international intellectual property laws.

You may not copy, reproduce, distribute, modify or create derivative works from any content without our prior written consent.

To the fullest extent permitted by law, Quick Response, Lda. shall not be liable for any indirect, incidental, special or consequential damages arising out of or in connection with the use of the Website or the purchase of products.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under Portuguese law.

Our processing of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Website you acknowledge that you have read and understood the Privacy Policy.

These Terms and any contract between us are governed by Portuguese law.

If you are a consumer, you may also benefit from mandatory consumer protection rules of your country of residence.

For disputes, consumers may use the European Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) or contact the Portuguese consumer arbitration centres.

Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Portugal, without prejudice to mandatory consumer jurisdiction rules.
